    These terms and conditions govern the sale of products and services to you by (the “Fitter") trading as an independent retailer through the Goodtyreguide.co.uk website (the “Website”) In addition to these terms and conditions, your use of the Website is subject to the Goodtyreguide.co.uk terms of website use and related documentation. Please read these conditions carefully before purchasing products and/or services from the Fitter via the Website. By ordering tyres or other products and/or tyre fitting or other services made available by the Fitter via the Website (respectively “Products” and “Services”), you signify your agreement to be bound by these terms and conditions. In the event of any inconsistency between these terms and conditions and the Goodtyreguide.co.uk terms of website use or any other documentation relating thereto, the terms and conditions set out herein shall prevail. You should print a copy of these terms and conditions for future reference. Please click on the button marked “I Accept” at the end of these terms and conditions if you accept them. Your Status 2.1 By placing an order with the Fitter through the Website, you warrant that: 2.1.1 you are legally capable of entering into binding contracts; 2.1.2 you are in the UK; 2.1.3 you are at least 18 years old; and 2.1.4 you have read and understood these terms and conditions. 3. How The Contract Is Formed Between You And The Fitter 3.1 After placing an order with the Fitter, you will receive an e-mail (the “Confirmation”) from the Goodtyreguide.co.uk on the Fitter’s behalf acknowledging and accepting your order. The contract between you and the Fitter (Contract) will only be formed when the Goodtyreguide.co.uk sends you the Confirmation on the Fitter’s behalf or, if earlier, when payment is processed. 3.2 The Contract will relate only to those Products and/or Services that have been confirmed in the Confirmation. The Fitter will not be obliged to supply any other Products and/or Services which may have been part of your order until such further Products and/or Services have been confirmed by a separate Confirmation. 3.3 The Fitter shall make attempts to ensure that the Products and/or Services shown on the Website are in stock and available for delivery at the time requested by you. However, if for any reason beyond the Fitter’s reasonable control, the Fitter is unable to supply a particular Product or Service or deliver the Product or Service on a date requested, the Fitter will not be liable to you except to ensure that you are refunded for any amount charged in respect of that Product and/or Service. 3.4 Please note that where a Product and/or Service is not available you will be sent an e-mail to offer you a substitute Product or Service and/or date for delivery of the Product or Service; you are not obliged to accept any such substitute and may demand a full refund. You will be informed of the price of the substitute Product and/or Service in the e-mail, if you choose to accept the substitute you will be refunded or charged, as the case may be, for the difference between the cost of the substitute and the Product or Service you originally ordered. 4. Consumer Rights 4.1 If you have ordered Products that will be dispatched to you and you are contracting as a consumer, you may cancel a Contract at any time within seven working days, beginning on the day after you receive the Products. In this case, you will receive a full refund of the price paid for the Products in accordance with the Fitter’s refunds policy (set out below). Please note that in the case of tyres, once they have been fitted to a vehicle they cannot be returned in the same condition as you bought them and your right to cancel shall end. 4.2 To cancel a Contract, you must inform the Fitter in writing. You must also return the Product(s) to the Fitter immediately, in the same condition in which you received them, and at your own cost and risk. You have a legal obligation to take reasonable care of the Products while they are in your possession. If you fail to comply with this obligation, the Fitter may have a right of action against you for compensation. 4.3 If you have ordered Services and you are contracting as a consumer, you may cancel a Contract at any time within seven working days, beginning on the day after you receive the Confirmation. In this case, you will receive a full refund of the price paid for the Services in accordance with the Fitter’s refunds policy (set out below). However, if the delivery of Services commences prior to the expiry of this period, your right to cancel shall end. 4.4 You will not have any right to cancel a Contract for the supply of any Products that are made to your specification or which are otherwise personalised for you 4.5 This provision does not affect your statutory rights in the event that the Products and/or Services are defective. 5. Availability And Delivery 5.1 Products and/or Services sold by the Fitter through the Website will be available for collection at the retail outlet that you specify in your order that is confirmed in the Confirmation and, where Products are to be dispatched to you, can only be dispatched to locations within the UK. 5.2 If your order relates to Products that will be dispatched to you, your order will be fulfilled by the delivery date set out in the Confirmation or, if no delivery date is specified, then within 30 days of the date of the Confirmation, unless there are exceptional circumstances. 5.3 If you fail to take delivery of the Products or Services then, without prejudice to any other right or remedy available to the Fitter, the Fitter may: 5.3.1 store the Products until actual delivery and charge you for the reasonable costs (including insurance) of storage and other expenses; or 5.3.2 sell the Products and (after deducting all reasonable storage and selling expenses) charge you for any shortfall below the price under the Contract; and 5.3.3 charge you for any reasonable costs incurred as a result of your failure to take delivery of the Services. 6. Risk And Title 6.1 The Products will be at your risk from the time of delivery. 6.2 Ownership of the Products will only pass to you when the Fitter receives full payment of all sums due in respect of the Products and/or Services, including any applicable delivery charges. 7. Price And Payment 7.1 The price of any Products and/or Services will be as quoted on the Website from time to time, except in cases of obvious error. 7.2 These prices include VAT. 7.3 Prices are liable to change at any time, but changes will not affect orders in respect of which you have received a Confirmation. 7.4 The Website contains a large number of Products and Services and it is always possible that, despite the Fitter’s best efforts, some of the Products and Services offered by the Fitter and listed on the Website may be incorrectly priced and/or unavailable. The Fitter will normally verify prices and availability as it processes the order. If a Product and/or Service specified in your order is unavailable the Fitter and/or the Goodtyreguide.co.uk will inform you by e-mail. If a Product’s or Service’s price is incorrect and is less than the price stated on the Website, the Fitter will charge the lower amount. If a Product´s or Service’s correct price is higher than the price stated on the Website, the Fitter will normally, at its discretion, either contact you for instructions, or reject your order and notify you of such rejection. 7.5 The Fitter is under no obligation to provide the Product or Service to you at the incorrect (lower) price, even after it has sent you a Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing. 7.6 You must provide your payment details when ordering the goods and payment will be processed immediately. 7.7 If you fail to make any payment by the relevant due date or if payment is declined or not authorised by the issuer of you credit/debit card when processed then, without prejudice to any other right or remedy available, the Fitter shall be entitled to: 7.7.1 cancel the Contract or suspend any further deliveries to you; and 7.7.2 charge you interest (both before and after any decree or judgement) on any amount unpaid in respect of Products or Services already delivered, calculated on a daily rate basis at the statutory rate of interest determined in accordance with the Late Payment of Commercial Debts (Interest) Act 1988 (as amended), until payment in full is made. 8. Seller’s Refunds Policy 8.1 When you return a Product or cancel or complain about a Service to the Fitter: 8.1.1 because you have cancelled the Contract within the seven-day cooling-off period (see clauses 4.1 and clause 4.3), the Fitter will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation. In this case, the Fitter will refund the price of the Product and/or Service in full, including the cost of sending the item to you, if any. However, if you have received the Product you will be responsible for the cost of returning it to the Fitter. 8.1.2 for any other reason, the Fitter will examine the returned Product or investigate the complaint and will notify you of your refund via e-mail within a reasonable period of time. The Fitter will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day the Fitter confirmed to you via e-mail that you were entitled to a refund for the defective Product and/or Service. Defective Services and Products returned by you because of a defect will be refunded in full, including a refund of the delivery charges for sending the item to you and the cost incurred by you in returning the item to the Fitter. 8.2 The Fitter will usually refund any money received from you using the same method originally used by you to pay for your purchase. 9. The Fitter disclaims all liability that may arise in the event that you order an unsuitable Product. 9.2 Subject to clause 9.1, the Fitter warrants to you that: 9.2.1 any Product purchased from it through the Website is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied; and 9.2.2 any Service purchased from it through the Website will be provided by suitably qualified personnel and with all necessary skill and diligence to satisfy generally accepted standards. 9.3 The Fitter will be responsible for any losses you suffer as a result of the Fitter breaching these terms and conditions if the losses were reasonably foreseeable to both you and the Fitter when you submitted your order to the Fitter, or a contract for the sale of goods and/or services by the Fitter to you was formed. The Fitter will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that was not reasonably foreseeable to both you and the Fitter when you submitted your order to the Fitter or when a contract for the sale of goods and/or services by the Fitter to you was formed.
